HIS EXCELLENCY THE PRESIDENT HON. WILLIAM SAMOEI RUTO, PhD, C.G.H, has today received the report of the tribunal appointed to consider the petition for removal of Juliana Whonge Cherera, Francis Mathenge Wanderi, Irene Cherop Masit and Justus Abonyo Nyang’aya from office as members of the Independent Electoral and Boundaries Commission.

The tribunal was appointed by His Excellency President Ruto on December 2, 2022, vide Kenya Gazette Notice No 14890, and pursuant to Article 251(4) of the Constitution and on the recommendation from the National Assembly.

The tribunal’s mandate was to primarily consider the petition for the removal of Cherera, Wanderi, Masit and Nyang’aya from office as members of IEBC, and to inquire into the allegations as was transmitted to the President by the National Assembly.

However, commissioners Nyang’aya, Cherera and Wanderi tendered their resignation from the commission on December 2nd, 5th and 8th, 2022 respectively. As a result, the tribunal only commenced proceedings to investigate the petition against Commissioner Masit.

The tribunal has discharged its functions to inquire into the allegations in the petition against Commissioner Masit in strict observance of the law and has prepared a report on the findings and recommendations.

Having considered all the evidence tendered and the requisite laws, the tribunal is satisfied that the allegations of serious violation of the Constitution and other laws, and gross misconduct have been proved to the required standard and qualify a recommendation for the removal from office of Commissioner Masit.

Having reached the conclusion, the tribunal therefore makes a recommendation that Commissioner Masit ought to be removed from the office of the IEBC commissioner.

In accordance with Article 251 (6) of the Constitution, the recommendation of the tribunal is binding on the President. Accordingly, the Head of State and Government shall act in accordance with the recommendations.

His Excellency the President has thanked the Tribunal for their sense of civic duty and for expeditiously discharging their constitutional mandate.

The tribunal comprised Chairperson Hon. Justice Aggrey Otsyula Muchelule, Judge of the Court of Appeal; Vice-Chairperson Carolyne Kamende Daudi and Linda Gakii Kiome, Mathew Njaramba Nyabena and Saeed Khamis Saeed as members. The Lead Counsel is Mr. Peter Munge Murage, Assisting Counsel Zamzam Abdi Abib and Joint Secretaries Kibet Kirui Emmanuel and Irene Tunta Nchoe.
